PLEASE NOTE: Pre-requisites for applicants/auditions

Aspiring participants are requested to carry the following details while visiting the audition center:

(i) Latest passport size photographs (3 nos.)
(ii) PAN Card [for Indian Nationals] / Driver's license/ Equivalent Identification for non-Indians.
(iii) Valid passport (not expiring before 31st of December 2011)
(iv) Voter's ID Card/ Latest Electricity Bill as proof of residence (in case permanent address mentioned in passport is different from the current residential address)
(v) Medical certificate from a doctor i.e. general practitioner, dated not more than 7 days prior to Audition date, certifying applicant’s physical fitness.

AUDITION RULES

I. INTRODUCTION:

By applying for participation in any manner laid down hereunder, the Applicant(s) confirm and agree that their participation in the Auditions/Program shall be subject to unconditional acceptance of the terms and conditions stated herein and as may be modified or amended and updated from time to time by the Company on its Website.

II. DEFINITIONS:

"Applicant": means any individual who meets the eligibility criteria set out in clause III herein below and who applies to the Company for participating in the Auditions in the manner prescribed herein, with the intention of participating in the Program, if selected by the Company, during the Audition.

"Audition(s)": means different levels of selection process which the Audition-Participants need to clear for participating in the Program.

"Audition Centre": means a location in any of the following cities where the Applicant(s) need to come for the Audition: Mumbai, Delhi, Chandigarh, or any other such City as the Company may nominate/determine at its sole discretion.

"Audition-Participants": means the Applicants short-listed by the Organisers for attending the Audition

"Channel": means any satellite television channel or other platform including mobile, internet etc. owned and operated by the STAR India Private Limited and/or any of its affiliated/group companies.

"Company" means STAR India Private Limited and/or its affiliates (individually or collectively).

"Contestant(s)" means Applicant(s) or Audition-Participant(s) or Participant(s), as the case may be.

"Final Part": means the part of the Program which is conducted at the Shoot Location whether or not recorded for transmission.

"Organisers" means STAR India Private Limited, and/or the Production House and/or their affiliates (individually or collectively as the case may be)

"Participant(s)": means the finalist(s) who has/have been short-listed by the Company post-clearance of the Audition and have made it to the Final Part of the Program.

"Production House": means the Miditech Private Limited, the production house appointed by the Company for the purpose of the Program.

"Program": means the program to be launched by the Company and tentatively titled "Survivor-India"

"Promotions": shall mean promotions of the Program and/or communication of the information regarding the Auditions/Program to the public via the Website, radio, Channel, banners/posters and/or any other media deemed fit by the Company.

"Schedule": means the schedule on which a set of Shows of the Program are to be recorded and/or recording dates as determined by the Company, in its sole discretion.

"Season": means any set of Shows of the Program, generally starting with a set of Participants and ending with the declaration of winner of the Program for that set of Shows amongst the Participants, in accordance with the format of the Program, or as may be decided by the Company at its sole discretion.

"Show(s)": means each episode of the Program including any Special Show(s).

"Shoot Location": means any indoor/outdoor location deemed fit by the Company for audio-visual recording of the Program.

"Special Show(s)": means any episode/s of the Program recorded with persons who are not Participant(s) and who may be celebrities or any other category of persons, as may be decided upon by the Company in its sole discretion. Such episodes may have additional rules (as amendments/attachments) with which the Participants agree comply, in addition to all the other rules of the Program.

"Walk-ins": Applicant(s) who has/have not registered to participate via Online/SMS/Landline numbers but has/have walked-in to the Audition Centre on the day and at the time of the Audition, as may be permitted by the Company in its sole and absolute discretion.

"Website": The Website located at the URL "www.starsurvivor.in" or such other website of the Company, as determined by the Company.

III. ELIGIBILITY FOR THE AUDITIONS:

To be eligible to apply to participate in the Audition, an Applicant must:
(i) be above the age of 18 years as on the date of Audition, and be competent to contract and should not be an employee of, or be a member of the immediate family of any employee of, any of the following:
a. the Organisers; or
b. the advertising agency appointed by the Organisers; or
c. any other agency or third party vendor which has been appointed from time to time by the Organisers in connection with the Program; or
d. the main sponsors.
(ii) be conversant with spoken Hindi;
(iii) meet such eligibility criteria set by the Company as to medical/physical fitness etc. as stated herein and as may be decided by the Company in its sole discretion from time to time;
(iv) sign and deliver to the Company, the Declaration-cum-Indemnity Agreement in the format provided by the Company.
(v) be medically fit to participate in the Auditions as substantiated by a medical certificate as prescribed in clause VI A hereinbelow.
(vi) not have entered into any prior agreement or arrangement which would conflict with her/his participation in the Audition and/or compliance with the terms and conditions contained herein, or any other rules relating to the Program or the Auditions;
(vii) should have necessary permissions/permits required for participation in the Audition and Program (in case of selection) and
(viii) apply in accordance with the procedure and terms and conditions laid down hereunder.

IV. DURATION OF AUDITIONS:

The Auditions shall be conducted by the Organisers, starting from such dates and time as mentioned in the Promotions. The duration of and schedule for the Auditions may be varied at any time by Company in its sole discretion without any prior notice.

V. PROCEDURE TO REGISTER FOR AUDITIONS:

(a) All registration entries for participation in the Auditions must be in person, in the required format and in the manner provided herein below. Any attempted registration for the Audition by proxy and/or in a different manner / format shall be null and void. Such registration for participation in the Audition does not guarantee that the Applicant would be invited to participate in the Audition.

(b) Each Applicant may register to participate in the Audition in the following manner:
i. For registering Online: Log on to the Website, go to the registration page, fill up the necessary details and submit the form provided. Alternatively, Applicant can reach the registration page for the Auditions through the link provided on the Company's page titled 'STAR PLUS' on www.facebook.com.
ii. For registering by way of SMS: Applicant shall type "SUR" in the message window of their mobile phones, send the message to 57827.
iii. For registering through our centralized landline number: Applicant shall call 022-65505558/9 and register their details as asked for.
iv. For registering by way of Walk-in: Walk-ins will qualify on the day of Auditions of Level 1 only at the Audition Centres in the respective cities. However, Applicants willing to register through Walk-ins will have to go through the registration process as may be prescribed and informed by the Company and/or its representatives at the Audition Centre and shall carry with them all required documents as mentioned herein. The first preference to appear for Audition will go to Applicants registering themselves through the Online/SMS/Landline numbers as stated above. Time permitting, Walk-ins will be allowed to Audition in such numbers and till such time as may be solely decided by the Company.
v. The SMS and Landline registration shall be open upto May 13th 2011 (both dates included) only. Any registration for the Audition attempted to be completed by SMS or Landline numbers after the lines have closed shall be null and void.
vi. The Company shall not be responsible for any internet / mobile / telecom service charges and/or liable in any manner whatsoever for any kind of interference or disruption encountered by the Applicant while attempting to register for the Audition.
vii. In the event, the mobile number (from which the SMS is sent) is not registered in the name of the person attempting to register for the Audition, he/she must submit a NO OBJECTION CERTIFICATE (NOC) from the person in whose name the mobile number or the telephone number is registered, to the Company within the time specified by the Company in the Promotions. Failure to do so shall render invalid the registration for participation in the Audition.

(c) The Company shall not be liable in any manner to update any Applicant(s) about the status/progress of his/her registration/application for participation in the Audition.

(d) No Applicant may register / attempt to register for participation in the Audition more than once. In case of multiple entries by same Applicant, only the first registered entry shall be considered for the purpose of selection by the Company.

VI. LEVELS OF AUDITIONS:

A. Level 1: (Eligibility Assessment and Casting/Group Discussions/Personal Interviews, etc.)

1. After the Applicant has registered for the Audition as required herein, the Production House will call back Applicants on a first cum first serve basis, from entries received in the above said manner.. The valid entries shall be contacted by the Production House or its duly authorised representatives/agents, on the basis of the contact details provided by such Applicant. In case the contact details provided by any of the selected Applicant is incorrect and/or such Applicant is not contactable/available when called/attempted to be contacted, the Company shall be entitled to disqualify the Applicant.

2. In case contact is established with the selected Applicant, the telephone conversation may be recorded and the Applicant will be asked to (i) confirm that they are willing to comply with the rules of the Program (and be advised of where to obtain copies of the same, if required), (ii) confirm their availability and provide all the necessary documentation to substantiate the information provided by the Applicant to the Company during the call. Further, the Applicant(s) may be asked personal details (e.g. full name, permanent present residence address, date of birth, mother's name, etc.) and any such other information as deemed fit by the Organisers, to check the eligibility of the Applicant to participate in the Audition/Program.

3. Receiving a call for capturing the personal details does not automatically qualify the Applicant to participate in the Audition, unless expressly conveyed by the Organisers.

4. The Audition-Participants attending the Audition on the date, venue and time as conveyed to them must carry to the Audition (original+3 sets photocopies):
(i) Latest passport size photographs (3 nos.) of the Audition-Participant
(ii) PAN Card [for Indian Nationals] / Driver's license/ Equivalent Identification for non-Indians.
(iii) Valid passport of the Audition-Participant(not expiring before 31st of December 2011, if it does, the Audition-Participant would need to supply a new passport within prescribed time, failing which he/she might be disqualified from the Audition/Program as the case may be);
(iv) Voter's ID Card/Passport/Latest Electricity Bill as proof of residence (in case the permanent address mentioned in the passport is different from the current residential address of the Audition-Participant.
(v) A medical certificate from a doctor i.e. general practitioner, dated not more than 7 days prior to the date of Audition, certifying the physical fitness of the Audition-Participant for the purpose of undergoing the Audition stages as stated hereinafter and specifying therein any ailment/disease pre-existing or existing on the date of issuing such certificate and/or any fact or condition (viz.: heart problem, blood pressure problem, pregnancy, etc.) which is likely to affect the performance of the Audition-Participant considering the Audition process and the Program, in case of selection as a Participant of the Program; and
(vi) A duly executed copy of Declaration-cum-Indemnity in the format provided by the Company.
(vii) any other documentation as may be mentioned in the Promotions and/or as required by the Company at the time of Audition and/or within prescribed time, if any.

5. The Auditions in this Level 1 may be conducted in various stages as deemed fit by the Company and may include, without limitation, casting, group discussions, personal interviews etc. wherein the Applicant(s) may also be asked to perform any task and/or fill up any questionnaire provided by the Company and the same may be recorded.

6. The gates of the Audition Centres shall remain open for the Applicant(s)/Audition-Participants only till 1 pm on Level 1 of audition unless decided otherwise by the Company and the Company shall not be obliged to entertain any Applicant(s)/Audition-Participant(s) (whether selected previously by the Company or Walk-ins) beyond the time of gate closure as aforesaid.

B. Level 2: (Physical Endurance Test and Psychoanalysis)

1. Level 2 of the Audition shall comprise of a psychoanalysis and physical endurance tests in the form and manner as prescribed by the Company (collectively "Tests"), in order to assess the mental and physical fitness of the Audition-Participants for sustaining the situations, perform the assigned tasks and the harsh conditions on isolated islands outside India that they shall be required to endure during the shoot of the Program, in case they are selected as Participants.

2. The Audition-Participants shall have to undergo the Tests as may be required by doctors/psychiatrists/physical trainers as may be appointed by the Company for the purpose of conducting the Tests.

3. The Audition-Participants shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the said doctors, physical trainers and/or the Company in its sole and absolute discretion.

C. Level 3: (Medical Examination)

1. The selected Audition-Participants who have cleared Level 2 and have been short-listed shall be required to reach the specified Audition Centre(s), on such date and time as informed by the Organisers for undergoing Medical examination.

2. The Level 3 Auditions shall be in nature of thorough medical examination of the Audition-Participants. The said medical examination shall be carried out at the cost of the Company and shall comprise of such tests/examinations as may be required by the Company. For the sake of clarity, the cost of medical examination referred in this clause shall not include any travel/lodging or any other expenses incurred by Audition-Participant for attending the medical examination.

3. The report submitted by the medical examiners post completion of all medical tests shall be final for the purpose of selection of the Participants for the Program.

VII. POST AUDITION FORMALITIES & FINAL PART OF THE PROGRAM

1. The Participants shall be required to enter into a contract with the Production House for the purpose of participation in the Program.

2. The Participants shall have to ensure that they are eligible to travel to designated place(s) for the recording / shoot of the Program on such dates/times, as may be informed to them by the Organisers. Participants shall be solely liable to obtain visas/permits/permissions as may be required for the participation in the Final Part of the Program, cost of which shall be borne by the Company.

3. The rules and regulations with regard to the Final Part of the Program and/or any other activities will be communicated and explained directly to the Participants by the Company prior to the recording of the Program.

4. The activities of the Participants will be recorded for such duration including up to 24 hours a day, as may be required considering the nature of the Program. The Participants may not be allowed to contact any person including their family members during their stay at the Shoot Location.

VIII. GENERAL RULES:

1. The Contestant(s) shall make themselves available, and if required stay, at/near the Audition Centre/Shoot Location, on the date and at the time as informed by the Company, for any or all of the Level(s)/Show(s) of the Audition(s)/Program. If the Contestant fails to do so, the Contestant(s) shall be disqualified from the Audition/Program and will not be able to participate in the Audition/Program. Further, any non-conformance by any Contestant to the rules of the Audition/Program may disqualify them from participation, as determined by the Company in its sole and absolute discretion.

2. The Applicant(s)/Audition-Participant(s) agree to attend all levels of the Auditions entirely at their own costs/expenses relating to lodging/boarding etc. unless otherwise expressly agreed by the Company at its sole discretion. In case the Applicant(s)/Audition-Participant(s), for whatever reason is not agreeable to the dates and/or venue of Audition and/or to travel, stay, etc. entirely at his/her own expense, for the purpose of participating in the Audition, the Company will regretfully consider the entry of such Applicant(s)/Audition-Participant(s) as invalid.

3. The Contestant agrees to do any and all acts and execute any and all documents in such manner and at such location as may be required by the Company in its sole and absolute discretion.

4. The Company reserves the sole discretion to decide, at any level/stage of the Audition/Program, the number of Contestants who may participate in the Audition/Show on any particular day. The Company shall not be obliged to adjust/accommodate and/or change the dates of Audition for any particular Applicant/Audition-Participant. The Company reserves the right to select/reject any Contestant at any stage of the Audition/Program for participation in any further level/stage of the Audition/Program, irrespective of successful completion of the various tasks/tests by such Contestant. The Company's decision in respect of (1) such selection/rejection, and (2) the number of Applicants selected from each city, for participation in the Audition/Program shall be final, non-contestable and binding on each Contestant. The Company shall not be obliged to provide any reasons in relation to selection or non-selection for participation in the Audition/Program to any of the Contestants.

5. The Company reserves the right to change the Audition Centre(s)/Shoot Location and/or alter/discontinue the procedure to register for Auditions and/or cease accepting entries for Auditions either entirely or for limited period and/or alter any activities/tasks at any stage of the Auditions/Program, in any manner whatsoever as deemed fit in its sole and absolute discretion without any prior intimation to the Contestants and/or the public.

6. Contestants must register themselves for the Audition/enter the competition at their own free will and using the best judgment of their abilities/capacity to endure the tasks which may be assigned to them at any stage of the Auditions/Program after making themselves well conversant with the format, rules and requirements of the Audition/Program, on their own behalf.

7. Failure to provide any document including the medical certificate in prescribed form and original passport (within a reasonable time, if allowed by the Company) may result in the disqualification of the Contestant irrespective of the stage of Audition / Program. The Company also reserves the right to disqualify any Contestant(s) (i) in case any discrepancy is found to exist in the information furnished/provided/stated by the Contestant during the conversation with the Company/details mentioned in any form filled in by the Contestant for the purpose of Audition and in the information(s) stated in the documents furnished by such Contestant, or (ii) if the Contestant refuses/fails to comply with any of the rules of the Audition/Program, or refuses/fails to comply with any direction given by any authorized representative of the Company, or refuses/fails to undertake/complete any of the Tests/tasks set by the Company.

8. In the event of any fault, misunderstanding or dispute concerning any part of the Program and/or the Auditions to qualify for the Program, the decision of the Company shall be final and binding on each Contestant.

9. The Company reserves the right to amend these rules as deemed fit or cancel/terminate any operation/recording/broadcast of any Show/Schedule and/or the Season of the Program or the Program itself at any time without any prior intimation or notice to any Contestant and/or public in general, for any reason whatsoever, including an event of force majeure. The Company is not obligated in any manner whatsoever to compensate any Contestant and/or accommodate any Contestant for in any further Season of the Program or any other program of the Company.

10. Each Contestant who registers to participate in the Audition agrees to abide by the terms and conditions stated herein including these General Rules.

11. Each Contestant agrees and acknowledges that all rights (including intellectual property rights) in any footage shot by the Company in relation to the Audition/Program by the Company including Footage in which they themselves are portrayed or footage of performance/conduct of various tasks/tests/interviews/activities etc., shall belong exclusively to the Company for the entire duration of their subsistence and throughout the world. No Contestant shall have any right, title or interest whatsoever in the same. Further, the Company may edit/alter any footage shot in relation to the Audition/Program without the consent of any Contestant, although the Company is not under any obligation to shoot any Footage, complete, broadcast or otherwise exploit any such footage.

12. The Company reserves all rights to make amendments to the existing rules without prior or subsequent notice to any Contestant or any other person. The Company shall not be responsible and/or liable in any manner whatsoever in case the Applicant(s) are unable to participate in the Audition due to failure on the part of any internet service provider, telecom operator, facility provider, etc.

13. Contestant agrees that he/she shall indemnify the Channel, Company, their employees, officers or their representatives in connection with the Auditions, from any loss, damage, costs, expenses (including reasonable attorney fees), suffered by the Company as a result of any act or omission and/or breach by the Contestant of the terms and conditions given herein and/or breach of any local laws and regulations. Contestant also waives his/her right to file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum against sponsor and/or the Channel/Company to claim any damages or reliefs.

14. Contestants agree to participate in the Audition/Program voluntarily and after making themselves aware of the rules, regulations and format of the Program and hence, notwithstanding clearance of the Audition levels or otherwise, the Company shall in no manner whatsoever be responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental and/or emotional trauma caused to any Contestant in any manner whatsoever, in relation to the Auditions and/or the Program

15. If any of the terms/conditions mentioned herein is held invalid by a court of competent jurisdiction or unenforceable or prohibited by the law of the country for the time being in force, only such term(s) and condition(s) shall be considered divisible as to such provision which shall be inoperative/illegal and the remainder of the terms and conditions shall be valid and binding.

16. No forbearance, indulgence or relaxation by the Company at any time to require performance of any term/condition/procedure contained herein shall in any way affect, diminish or prejudice the right of the Company to require performance of the same or any other provision; similarly, any waiver or acquiescence by the Company of any breach of any provision contained herein shall not be construed as a waiver or acquiescence of any continuing or succeeding breach of such provisions or any other provision(s), or as a waiver of any right under or arising out of these terms and conditions, or acquiescence to, or recognition of rights and/or position other than as expressly stipulated herein.

17. If any dispute or grievance arises in connection with the validity, implementation, etc. in relation to the Auditions or the Program, the Contestant agrees and undertakes that such dispute or grievance which may arise shall be subject to arbitration to be conducted by a sole arbitrator, who shall be a senior official of the Company or a third party appointed by the Company. The arbitration proceedings shall be held under the Arbitration and Conciliation Act, 1996 and the Rules frames thereunder. The place of arbitration shall be Mumbai. The proceedings of arbitration shall be in held in Mumbai and in English language. The costs, charges and expenses in relation to the Arbitration shall be equally borne by Organisers and the Contestant. The sole arbitrator shall have no jurisdiction to grant interest. The decision of the sole arbitrator in this regard shall be final and binding on the Contestant and the Company. Subject to the provision of this clause, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, the provision of interim reliefs under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India. The law governing arbitration shall be Indian law.

18. These terms and conditions shall be governed exclusively by Indian law without reference to its conflict of law rules, and subject to the arbitration provision stated hereinabove, courts of Mumbai shall have exclusive jurisdiction to determine any dispute which may arise with reference to these terms and conditions / the Audition/the Program.
